Bayer Statement Regarding Ruling on Monsanto’s Motion for Nonsuit in Pilliod Case
The following is Bayer’s statement regarding Judge Winifred Smith’s ruling on Monsanto’s Motion for Nonsuit in the Pilliod glyphosate-based herbicide trial in the Superior Court of the State of California for the County of Alameda.
“Bayer is disappointed with the Court’s decision, as we believe that the plaintiffs have not presented sufficient evidence to support their case, including on causation and failure to warn. In addition, the evidence in this case falls well short of the malice and oppression standard required under California law to support punitive damage claims. It is undisputed that health regulators across the world have determined that glyphosate can be used safely and is not carcinogenic, and it is notable that this decision was made on the very day when EPA reaffirmed its conclusions that glyphosate is not carcinogenic in its interim registration decision.”
