Bayer Statement on 11th Circuit Order Granting the Company’s Petition for Rehearing En Banc in Carson
Bayer today issued the following statement on the Eleventh Circuit order granting the Company’s petition for rehearing en banc in Carson:
“We are pleased with the decision and look forward to presenting our legal arguments to the full Eleventh Circuit that the panel’s decision effectively nullified FIFRA’s statutory uniformity provision and is contrary to Supreme Court precedent. A cancer warning on the company’s glyphosate-based Roundup™ would conflict with its EPA-approved labeling, render the product misbranded, and would be contrary to the consistent conclusions of EPA’s scientific assessments for more than four decades.”
“Bayer continues to stand fully behind its Roundup™ products, as the weight of scientific evidence and the conclusions of expert regulators worldwide continue to support the safety of glyphosate-based herbicides and that they are not carcinogenic.”
