Q&A: Alston & Bird’s Clay Massey on evidence in Roundup bellwether trial

The first federal bellwether trial in a lawsuit alleging Bayer AG’s glyphosate-based weedkiller causes cancer has renewed a debate over the presentation of scientific evidence in the courtroom.

U.S. District Judge Vince Chhabria in San Francisco, who is overseeing the Roundup multidistrict litigation and the currently ongoing test trial, in the past has frequently described plaintiffs’ evidence of Roundup allegedly causing non-Hodgkin’s lymphoma as “weak” and “shaky.”
